RE: The tariff classification of a headwrap and headbands from China.
Dear Ms. Ritchings:
In your letter dated June 6, 2005, you requested a tariff classification ruling.
The submitted samples are as follows:
Model 49764NNPNP 6 Pack Non Metal Elastic Headwraps consists of elastic headbands measuring approximately 3/8” in width.
Model 58423 Spray Paint Headband is made of a rigid horseshoe shaped headband wholly covered with fabric.
Model 49669N 4 Pack Thin Plastic Headbands consist of one brown, one blue, one black and one white plastic horseshoe shaped headband.
The applicable subheading for Model 4976NNPNP 6 Pack Non Metal Elastic Headwraps will be 5609.00.3000, Harmonized Tariff Schedule of the United States (HTS), which provides for “Articles of yarn, strip, or the like of heading 5404 or 5405, twine, cordage, rope, or cables, not elsewhere specified or included: Of man-made fibers.” The rate of duty will be 4.5% ad valorem.
The applicable subheading for Model 58423 Spray Paint Headband will be 9615.90.6000, HTS, which provides for “Combs, hair-slides and the like… Other: Other: Other.” The rate of duty will be 11% ad valorem.
The applicable subheading for Model 49669N 4 Pack Thin Plastic Headbands will be 9615.11.4000, HTS, which provides for “Combs, hair-slides and the like… Of hard rubber or plastics: Other: Not set with imitation pearls or imitation gemstones.” The rate of duty will be 5.3% ad valorem.
